AVIATION

The Firm has a strong and proven track record in advising stakeholders across the aviation value chain, including scheduled and non-scheduled operators, OEMs, aircraft and engine lessors, export credit agencies, and global lenders. Our aviation practice spans both domestic and cross-border transactions, with deep familiarity in aligning Indian legal requirements with international aviation frameworks. We regularly advise on the acquisition, financing, leasing, and transfer of both new and pre-owned aircraft and engines, and are well-versed in operating leases, finance leases, sale-and-leaseback arrangements, and structured finance transactions involving aircraft assets.

The Firm has considerable experience with issues arising under the Convention on International Interests in Mobile Equipment and its Protocol on Matters Specific to Aircraft Equipment (the Cape Town Convention), to which India is a contracting state. We assist clients in Registering international interests with the International Registry (IR), structuring transactions to ensure compliance with the Cape Town Convention and Aircraft Protocol, facilitating IDERA filings and enforcement actions in coordination with the DGCA and other Indian authorities.

Our team has successfully assisted in repossession, de-registration, export, and sale of aircraft and engines, including post-default enforcement actions in India. We also engage with local aviation authorities and represent clients in proceedings related to aircraft repossession, lessor rights, and regulatory clearances. With a detailed understanding of both Indian aviation regulations and the global legal instruments governing aircraft finance, the Firm provides end-to-end legal support across the aircraft life cycle-from acquisition and operation to enforcement and disposition.
